How does the trademark price calculator work?
Information about the trademark registration
To calculate the cost of trademark registration, it's essential to provide accurate initial information. The cost of registering a trademark can vary depending on the country or countries where you intend to protect the trademark.
Each country's trademark registration office defines and updates the trademark registration fees annually.
Selection of classes for trademark registration
Some inventors and entrepreneurs believe that trademarking a brand protects it from any use, anywhere in the world, and across all industries, products, or services.
It doesnât work that wayÂ
First of all, trademark protection is only effective in the country or countries where the trademark registration has been formalized and the corresponding fees have been paid.
Secondly, trademarks are not protected universally across all industries. There is an established system of 45 recognized classes, sectors, or industries. You must select as many of these classes as apply to your case.Â
For example, if we have a brand called âLetâs Prototypeâ and we intend to sell electronic toys under that name, the trademark should be registered in the markets where the products will be sold, and also in the following classes:
- Class 28 â Toys and Sporting GoodsÂ
- Class 9 â Electronic DevicesÂ
- Class 41 â Education and Entertainment
The products and services we intend to market under a brand are what define the class or classes that should be associated with it.Â
Trademark protection is limited by country and by class.Â
To calculate the cost of trademark registration, it is essential to gather information about the countries of registration and the selected classes. Of course, both elements are taken into account in the way our trademark price calculator works.
Calculate the cost to register a trademark in the United States
To calculate the cost of trademark registration in the USA, you must add: the average cost of a trademark search (optional) + official filing fees + the attorneyâs trademark legal fees.
The official fees to register a trademark in the USA, are calculated as follows:
$250.00 for each selected class.Â
For example, using the Letâs Prototype case and electronic toys as a reference, we identify the possibility of registering the trademark under 3 different classes. In the United States, the official trademark registration fee would be $750.
As with the procedures to patent in the United States, the USPTO offers a faster track or priority route to complete the registration. If you require an urgent trademark registration, you can proceed with it; however, in this case, the fee per selected class will be $300.
Using the same trademark registration example, the total cost would be $1,050.
Remember that to calculate the cost of registering a trademark in the USA, you must add the official fees, the professional fees of your legal representative, and optionally, the cost of hiring brand designers to conduct trademark clearance searches for existing marks that could interfere with your trademark protection process.
Calculation of the Cost to Register a Trademark in Europe
Calculating the cost to register a trademark in Europe is simple and fast. In our trademark calculator, the trademark price is calculated by adding the official fees to the fees charged by intellectual property professionals.
As in the United States, the official fees for trademark registration depend on the number of classes associated with the registered trademark.
In Europe, registering a trademark in a single class has an official cost of âŹ850. Registering in two classes or sectors costs âŹ900, and three classes cost âŹ1,050. Starting from the fourth class, an additional âŹ150 will be added per class.
Calculate the Cost to Register a Trademark in Spain
To calculate the cost of trademark registration in Spain, you need to know the official OEPM fee and the cost of the trademark attorneys who will assist you with the registration process.
In Spain, registering a trademark with one selected class or sector has an official cost of âŹ125. If you need to register the trademark in two classes, the cost would be âŹ200; for three classes, âŹ275. Starting from the fourth class, you must add âŹ75 for each additional class.Â
For example: the registration of a mixed trademark for 5 classes, sectors, or industries would cost âŹ425.
How to Know if a Trademark is Registered?
As you know, the formula to determine the cost of registering a trademark is:
Trademark Registration Cost = Professional Fees + Official Fees + Trademark Search (optional)
The trademark clearance search aims to identify the real possibilities of registering a trademark.
In most common cases, people usually register a brandâs logo, the brand name, or a combination of bothâthe logo with the name. It is true that a partial registration can be done, either for the name or for the illustrative part only.
Letâs take as a reference a mixed trademark registration (logo + name), which is ultimately the most common scenario.
The research process to find out if a trademark already exists is carried out by following these steps:
- Define the countries where you are interested in registering your trademark.Â
- Identify the official trademark office website of the country. For example: in Spain, itâs the OEPM; in the USA â the USPTO.Â
- Open the registered trademark search tool.Â
- Perform a semantic search. This will allow you to identify semantic similarities with other trademarks, specifically in the country and the classes where you intend to protect your trademark.Â
- Perform a visual search. In this case, you can enter shape and color descriptions into the search tool to find other trademarks that may be registered in the same class where you intend to register your trademark.Â
Of course, you can perform the search for registered trademarks on your own, without the help of a professional, and thus save the cost of this service.
