Patente o el prototipo. El huevo o la gallina

I am referring to the big question every inventor has: What comes first, the patent or the prototype?
It’s very likely that you have no doubts: “The patent.”
Ahora lee con atención el caso de Paco:
Paco trae a Prototécnica una gran idea para que la transformemos en un prototipo funcional.
Tras analizar los detalles del invento patentado por Paco, concluimos que:
- Paco ha identificado una gran oportunidad en el mercado.
- El producto que se describe en la patente, es inviable técnicamente.
- Hay mejores formas y tecnología disponible para convertir el producto de Paco en una realidad.
Este escenario, lamentablemente, es más común de lo que imaginas. Por ello,, he decidido compartir contigo estos 3 consejos:
- Ni las patentes ni los Modelos de Utilidad se modifican. Si no quieres tirar el dinero, debes estar muy seguro de haber construido lo correcto antes de protegerlo legalmente.
- Tener un título de Modelo de Utilidad, no es garantía de que funcione técnicamente.
- Los Modelos de Utilidad “AMPLIOS” como nos venden muchas veces, no valen para nada. Es como decir: vamos a crear un Modelo de Utilidad que no diga nada para que nadie se sienta identificado. Eso no es innovar, muchos menos proteger.

Erick Remedios has been involved in entrepreneurship, private investment, and the launch of innovative projects for over a decade. He began his career at Business In Fact, S.A.—a private investor network specializing in high-risk investments—where he rose to the position of Managing Director, participating in more than 40 investment deals and advising early-stage entrepreneurs and investors.
