La falsa adrenalina de los Inventores.<\/h1>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-71efcb26 elementor-widget elementor-widget-text-editor\" data-id=\"71efcb26\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Al menos el 80% de nuestros clientes, llegan a Let&#8217;s Prototype creyendo tener una \u201cmini-patente, pre-patente, antecedente de patente, patente express\u201d, entre otros t\u00e9rminos creativos, con los que les han \u201cconvencido\u201d para contratar la protecci\u00f3n de su invento a trav\u00e9s de un <b>Modelo de Utilidad<\/b>.\u00a0<\/p><p>Probablemente, no habr\u00edas terminado de contar tu idea, cuando comenzaron a llover argumentos para desarrollar un <b>Modelo de Utilidad<\/b> en lugar de una <b>Patente<\/b>. \u00a1Claro! Pero, es m\u00e1s f\u00e1cil convencernos sobre las bondades de las \u201c<b>Pre-Patentes<\/b>\u201d, t\u00e9rmino con el que se sigue acu\u00f1ando popularmente al Modelo de Utilidad.\u00a0<\/li><li aria-level=\"1\">Solicitar una <b>Patente<\/b> cuesta mucho m\u00e1s caro que un <b>Modelo de Utilidad<\/b>. Est\u00e1 claro, <b>proponer la Patente a la mayor\u00eda de inventores, representar\u00eda la desaparici\u00f3n de al menos el 30% de los proveedores de estos servicios.<\/b> (Siendo muy prudente)<\/li><li aria-level=\"1\">Tomando como referencia el a\u00f1o 2020, el 69% de los <b>Modelos de Utilidad<\/b> solicitados, fueron concedidos. En el caso de las patentes, solo se aprobaron el 25%. <b>\u00bfPara qu\u00e9 complicarse? El atajo es\u2026 Modelos de Utilidad para todos.<\/b><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a5b8935 elementor-widget elementor-widget-text-editor\" data-id=\"1a5b8935\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Por supuesto, no nos ce\u00f1iremos solo a nuestra experiencia ante tan inquietantes conclusiones.\u00a0<\/p><p>Al revisar las definiciones t\u00e9cnicas de <b>Modelo de Utilidad<\/b> y <b>Patente<\/b>, encontramos que ambos m\u00e9todos persiguen un objetivo com\u00fan \u201c\u2026fomentar la innovaci\u00f3n y proteger los derechos de los inventores.\u201d En cambio, en el caso del Modelo de Utilidad, se define, <i>\u201c\u2026 El <\/i><b><i>Modelo de Utilidad<\/i><\/b> <b><i>protege invenciones con menor rango inventivo<\/i><\/b><i> que las protegidas por Patentes, consistentes, por ejemplo, en dar a un objeto una configuraci\u00f3n o estructura de la que se derive alguna utilidad o ventaja pr\u00e1ctica<\/i><b><i>\u201d. <\/i><\/b>Entonces, <b>El Modelo de Utilidad, <\/b>no es una Pre-Patente. Obtener un t\u00edtulo de <b>Modelo de Utilidad<\/b>, no acerca al inventor a la obtenci\u00f3n de una Patente.\u00a0<\/p><p class=\"p1\">\t\t<div data-elementor-type=\"section\" href=\"https:\/\/www.oepm.es\/es\/propiedad_industrial\/preguntas_frecuentes\/FaqCuestiones32.html?modalidadFaq=noSel\">Oficina Espa\u00f1ola de Patentes y Marcas<\/a>, en el caso de los <b>Modelos de Utilidad, <\/b>las tasas administrativas cuestan <b>101,38\u20ac,<\/b> mientras que, en el caso de las Patentes, ronda los 1200\u20ac. Pero la exagerada diferencia entre las tasas, no es representativa, la diferencia entre ambas, es aun mayor cuando sumamos los honorarios de los profesionales que nos acompa\u00f1an en ambos procesos.
