En cambio, m\u00e1s del 90% de los inventores falla en esta elecci\u00f3n.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Para muchos inventores <\/span><a href=\"https:\/\/letsprototype.com\/como-patentar-una-idea-en-usa\/\"><b>obtener una patente <\/b><\/a><span style=\"font-weight: 400;\">es un gran hito, en cambio, m\u00e1s del 90% de las patentes de particulares describen <\/span><b>ideas en etapas prematura<\/b><span style=\"font-weight: 400;\">s y con poco rigor t\u00e9cnico.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-085735a elementor-widget elementor-widget-heading\" data-id=\"085735a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">El fen\u00f3meno de las patentes prematuras.\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-addb301 elementor-widget elementor-widget-text-editor\" data-id=\"addb301\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">En <\/span><a href=\"https:\/\/letsprototype.com\/\"><b>Let\u00b4s Prototype<\/b><\/a><span style=\"font-weight: 400;\"> llamamos <\/span><b>patente prematura<\/b><span style=\"font-weight: 400;\">, a los <\/span>registros de propiedad industrial <span style=\"font-weight: 400;\">que describen inventos que no han sido probados a nivel de laboratorio de innovaci\u00f3n. Las <\/span><b>patentes prematuras<\/b><span style=\"font-weight: 400;\"> son descripciones vagas sobre principios funcionales y\/o productos que, aunque pueden derivarse de muy buenas ideas, no est\u00e1n en el punto \u00f3ptimo para ser registradas.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e6416e2 elementor-widget elementor-widget-heading\" data-id=\"e6416e2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Riesgos de las patentes prematuras. <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c07ea9 elementor-widget elementor-widget-text-editor\" data-id=\"2c07ea9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>Riesgo legal:<\/b><span style=\"font-weight: 400;\"> Realmente<\/span><b> las ideas no son patentables<\/b><span style=\"font-weight: 400;\">. Se presupone que la presentaci\u00f3n de una patente es un proceso posterior a la innovaci\u00f3n, dise\u00f1o y test de un producto que aporta mejoras sustanciales. Por tanto, patentar un \u201cinvento\u201d en fase de \u201cidea\u201d contradice los principios b\u00e1sicos de la ley de patentes.\u00a0<\/span><\/p><p><b>Riesgo de copia: <\/b><span style=\"font-weight: 400;\">Las <\/span><b>patentes prematura<\/b><span style=\"font-weight: 400;\">s, en lugar de ofrecer una buena <\/span><b>protecci\u00f3n del invento<\/b><span style=\"font-weight: 400;\">, motivan su copia. La falta de <\/span><b>rigor t\u00e9cnico<\/b><span style=\"font-weight: 400;\"> en la descripci\u00f3n de la patente, el desconocimiento t\u00e9cnico manifiesto en estos documentos y la falta de visi\u00f3n sobre el ciclo de innovaci\u00f3n, expone inventos claramente mejorables que son aprovechados por quienes s\u00ed conocen los pasos adecuados y tienen los recursos disponibles.\u00a0<\/span><\/p><p><b>Riesgos de protecci\u00f3n futura: <\/b><span style=\"font-weight: 400;\">El <\/span><b>registro de patentes prematuras<\/b><span style=\"font-weight: 400;\"> o lo que es m\u00e1s frecuente, <\/span><a href=\"https:\/\/letsprototype.com\/modelo-de-utilidad\/\"><b>modelos de utilidad<\/b><\/a><span style=\"font-weight: 400;\">, genera un antecedente sobre un invento que muchas veces es claramente mejorable. En cambio, cuando se consiguen estas mejoras, patentar el invento es un aut\u00e9ntico caos, ya que es dif\u00edcil demostrar que es sustancialmente diferente al <\/span><b>producto imaginario <\/b><span style=\"font-weight: 400;\">que se ha patentado antes, incluso, cuando el inventor es la misma persona.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41a6cae elementor-widget elementor-widget-heading\" data-id=\"41a6cae\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Patentes prematuras Vs Patentes a t\u00e9rmino\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd6e596 elementor-widget elementor-widget-text-editor\" data-id=\"cd6e596\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Las <\/span><b>patentes prematuras<\/b><span style=\"font-weight: 400;\"> como hemos visto antes, son registros de propiedad industrial que describen ideas con escasos ciclos de prueba en laboratorios de innovaci\u00f3n. Entorno propicio para su desarrollo, comparaci\u00f3n con alternativas de mercado y an\u00e1lisis t\u00e9cnico para incorporar mejoras sustanciales.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Por el contrario, las patentes a t\u00e9rmino, describen inventos en los registros de la propiedad industrial, que han sido sometidos a intensos <strong>ciclos de innovaci\u00f3n<\/strong>. Se ha comprobado que: con cambios no obvios, estos productos aportan un valor a\u00f1adido demostrable.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76caeeb elementor-widget elementor-widget-heading\" data-id=\"76caeeb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Herramientas para evitar patentar antes de tiempo\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-14365aa elementor-widget elementor-widget-text-editor\" data-id=\"14365aa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Existen dos alternativas \u00fatiles para evitar el registro prematuro de patentes. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-013f176 elementor-widget elementor-widget-heading\" data-id=\"013f176\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Secreto industrial temporal<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-52dd818 elementor-widget elementor-widget-text-editor\" data-id=\"52dd818\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">El <\/span><b>secreto industrial temporal<\/b><span style=\"font-weight: 400;\">, responde a la generaci\u00f3n de un espacio secreto, controlado por contratos de NDA suficientes para proteger el ciclo de innovaci\u00f3n. Estos contratos de confidencialidad deben afectar a los <\/span><a href=\"https:\/\/letsprototype.com\/\"><b>fabricantes de prototipos<\/b><\/a><span style=\"font-weight: 400;\">, dise\u00f1adores, socios, colaboradores y toda persona o empresa involucrada en el ciclo de innovaci\u00f3n.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Cuando hay avances importantes en el ciclo de innovaci\u00f3n, pero no los suficiente para demostrar que el producto est\u00e1 en el punto adecuado para registrar patentes, puede tener sentido registrar ante notario estos avances. De esta forma se deja constancia de: la propiedad del invento y las fechas en las que se consiguen puntos importantes del ciclo de innovaci\u00f3n.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">El <\/span><b>registro de un invento ante notario<\/b><span style=\"font-weight: 400;\">, no garantiza ni genera precedentes \u00fatiles ante la oficina de patentes. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-60c088a elementor-widget elementor-widget-heading\" data-id=\"60c088a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\"><a href=\"https:\/\/letsprototype.com\/patente-provisional\/\">Patentes provisionales en USA<\/a><\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9081886 elementor-widget elementor-widget-text-editor\" data-id=\"9081886\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Las <\/span><a href=\"https:\/\/letsprototype.com\/patente-provisional\/\"><strong>patentes provisionales<\/strong><\/a><span style=\"font-weight: 400;\"> son registros secretos pero oficiales ante la oficina americana de patentes y marcas.
